Terms of service
1. Agreement to these terms
These Terms of Service apply to every visit to carbonpower.shop and checkout.carbonpower.shop and to every purchase from CarbonPower LLC ("CarbonPower," "we," "us"). By placing an order you confirm that you are at least 18 years old and that you have read and accept these Terms together with our Refund Policy, Shipping Policy, Warranty & Returns page and Safety & Liability Disclaimer. At checkout you confirm this by ticking the agreement box before you can pay.
Please read section 24 (Arbitration and class-action waiver) and section 15 (Release) carefully. They affect how disputes are resolved and what claims you can bring. You may opt out of arbitration as explained in section 24.
2. Who we are
CarbonPower builds custom steering wheels, airbag covers and related interior styling parts. Every product is an aftermarket part. Unless a listing says otherwise, nothing we sell is made, approved or endorsed by a vehicle manufacturer, and brand names, logos and model names appear on our site only to describe which vehicles a part fits.
3. Built to order and natural variation
Most items are built after you order, from the options you choose. Hand-laid carbon, forged carbon, leather, suede, Alcantara and stitching all vary a little from piece to piece, and colors can look different on a screen than in person. That variation is part of a handmade product and is not a defect. Photos on our site and social media may show earlier customer builds. We may improve materials or construction over time without notice.
4. Orders, pricing and payment
We may decline, limit or cancel any order, ask for extra verification, or cancel orders that look fraudulent or that are placed for resale without a written dealer agreement. If an item is listed at the wrong price or with wrong details because of a mistake, we may cancel the affected order, even after you have paid, and refund what you paid. Prices are in U.S. dollars, can change at any time, and taxes are calculated at checkout. We do not adjust the price of an order after it is placed. If you pay with an installment provider (such as Shop Pay Installments or PayPal Pay Later), your repayment terms are between you and that provider.
5. Discounts and promotions
- One discount code per order unless a promotion clearly says codes can be combined.
- Codes apply to products only, not to shipping, taxes, duties or gift cards, unless the promotion says otherwise.
- Codes have no cash value, cannot be applied to orders that were already placed, and end on the stated expiry date or when we withdraw them.
- Codes issued to a specific person (for example, a creator, referral or apology code) may only be used by that person or their audience as intended. We may cancel orders that use codes obtained by mistake, through code-sharing sites, through multiple accounts, or in any way we reasonably believe is abusive, and refund what you paid.
- If a discounted order is returned or partly refunded, the refund is based on the price you actually paid.
6. Build approval
After you order we send a build confirmation listing your exact specifications. Production starts only after you approve it, and never before your 24-hour free-cancellation window closes. If you do not reply within 48 hours, we treat the specifications you submitted at checkout as approved. Before your order ships we send photos of the finished build. Any concern that it does not match your approved specifications must reach us within 48 hours of the photos. After that the build is accepted.
7. Cancellations and changes
You can cancel within 24 hours of purchase for a full refund. After 24 hours and before production starts, a 30% cancellation fee (based on the product price) applies. Once production starts or the order ships, it cannot be canceled, except under the shipping-delay rights in our Shipping Policy, which always allow a full refund. Changes are free within 24 hours. Later changes are at our discretion, may change the price and timeline, and are not possible once production starts.
8. Returns and refunds
Every return needs a written return authorization (RMA). Defects, wrong items and transit damage must be reported within 48 hours of delivery with photos and are returned free. If your order arrives exactly as you approved it and you no longer want it, you may request a return within 7 days of delivery; a 30% restocking fee (based on the product price you paid) is deducted, original shipping is not refunded, and you pay return shipping and carry the risk of loss until we receive the item. Installed, test-fitted, altered or used items, and builds with custom logos, text or artwork (unless defective), cannot be returned. Full details are in our Refund Policy.
9. Shipping, title and risk of loss
We ship U.S. orders from Miami, Florida, and international orders directly from our production facility. Title and risk of loss pass to you when the carrier takes the package. Every U.S. order ships insured, and we handle carrier claims on insured shipments. Ship-by commitments, delay notices and your right to cancel for a delay are set out in our Shipping Policy.
10. Limited warranty
CarbonPower steering wheels carry a written limited warranty: 24 months on the structure and clear coat of the carbon shell, and 12 months on stitching, LED displays, heating and other electronics, and wiring we supply. Full terms, exclusions and the claim process are on our Warranty & Returns page. The warranty is for the original buyer and is not transferable.
11. No other promises
Only the written limited warranty described above is a warranty. Product descriptions, photos, videos, social media posts, advertising, and anything said by phone, chat, text or in person describe our products but are not warranties and do not change these Terms. No one at CarbonPower can change these Terms except in a written document signed by the owner of CarbonPower LLC.
12. Fitment is your responsibility
You are responsible for choosing the correct vehicle, model year, trim, options and specifications and for confirming compatibility before ordering. Fitment can vary with trim, market, transmission, factory options and earlier modifications. Our fitment guide is information, not a guarantee. If you are unsure, message us before ordering. We are not responsible for orders placed for the wrong vehicle, or for coding, programming, electronic compatibility, labor or dealer charges.
13. Airbags and road legality
Steering wheels and airbag covers sit next to safety systems. Airbag modules are not included unless a listing says so, and CarbonPower does not sell, open, repair or modify airbag modules or inflators. Airbag covers are cosmetic replacement covers only. Our parts have not been tested for, or certified to, the Federal Motor Vehicle Safety Standards (FMVSS) or any other government standard, and depending on where you live they may be intended for show, off-road or competition use. We make no promise about airbag deployment or performance after installation. You are responsible for checking whether a modification is legal where you drive and how it affects your insurance and inspections. See our Safety & Liability Disclaimer.
14. Installation and assumption of risk
CarbonPower does not install products, and any guidance we give is general. Have a qualified technician install your wheel. Before touching any airbag part, disconnect the battery and wait at least 15–30 minutes. Mistakes during installation or use can cause airbag malfunction, loss of steering control, vehicle damage, serious injury or death. You choose to modify your vehicle, and you accept the risks of installing and using aftermarket parts.
15. Release
TO THE FULLEST EXTENT FLORIDA LAW AND OTHER APPLICABLE LAW ALLOW, YOU RELEASE CARBONPOWER LLC, ITS OWNER, EMPLOYEES AND SUPPLIERS FROM CLAIMS FOR DAMAGE TO YOUR VEHICLE OR OTHER PROPERTY, LOSS OF USE AND OTHER ECONOMIC LOSS THAT ARISE FROM THE INSTALLATION, REMOVAL, MODIFICATION OR USE OF PRODUCTS YOU BUY FROM US, INCLUDING CLAIMS BASED ON OUR OWN ORDINARY NEGLIGENCE. This release does not apply to: (a) claims for death or bodily injury, to the extent the law does not allow them to be released in advance; (b) gross negligence, intentional misconduct or fraud; (c) your rights under our written limited warranty and any implied warranty while it lasts; or (d) any other right that cannot be waived by law.
16. Indemnification
To the extent the law allows, you agree to defend, indemnify and hold harmless CarbonPower LLC and its owner, employees and suppliers from third-party claims, losses and expenses (including reasonable attorneys' fees) that arise from your installation, modification or use of products you bought, your breach of these Terms, or your violation of any law. This does not require you to cover claims caused by our own gross negligence or intentional misconduct.
17. Implied warranties
ANY IMPLIED WARRANTY THAT APPLIES TO A PRODUCT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, LASTS ONLY AS LONG AS THE WRITTEN LIMITED WARRANTY FOR THAT PART OF THE PRODUCT (24 MONTHS FOR THE CARBON SHELL AND CLEAR COAT, 12 MONTHS FOR EVERYTHING ELSE). Some states do not allow limits on how long an implied warranty lasts, so this limit may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
18. Limitation of liability
To the maximum extent the law allows, CarbonPower is not liable for indirect, incidental, special or consequential damages, including vehicle downtime, loss of use, installation, removal or labor costs, towing, rental cars or lost profits. For any claim relating to a product, our total liability will not exceed the price you paid for that product, not counting shipping, taxes, duties or labor. Nothing in these Terms limits liability for death or bodily injury, or any other liability, where the law does not allow it to be limited.
19. Customer photos and reviews
We photograph finished builds and may use those photos, plus photos, videos or reviews you send us or tag us in, on our website, social media and advertising without payment. We never publish your full name, license plate or contact details. To opt out, email us and we will stop using your content going forward. We do not penalize honest reviews, positive or negative.
20. Custom logos, text and designs
If you ask us to add a logo, emblem, text or artwork, you confirm that you own it or have permission to use it, and you are responsible for it. We may refuse any design we believe infringes someone else's trademark or copyright or is offensive. Builds with custom artwork cannot be returned unless they are defective.
21. Text messages (SMS)
If you opt in to CarbonPower text messages (for example, by ticking the SMS box at checkout, entering your number in a sign-up form, or texting a keyword to us), you agree to receive recurring automated marketing and promotional texts, such as new products, restocks, discounts and build updates, from or on behalf of CarbonPower at the mobile number you provide.
- Consent is not a condition of any purchase.
- Message frequency varies. We send marketing texts only between 8 a.m. and 8 p.m. in your local time.
- Message and data rates may apply.
- Reply STOP (or a similar word such as END, QUIT, CANCEL or UNSUBSCRIBE) at any time to stop marketing texts. You can also opt out by emailing or calling us. We will process every opt-out promptly and never later than 10 business days after we receive it, and we may send one final text confirming it.
- Reply HELP for help, or contact us at carbonpowercustoms@gmail.com or +1 786-304-3801.
- Mobile carriers are not liable for delayed or undelivered messages.
- If you change or give up your mobile number, please opt out first or tell us, so texts do not reach the next owner of that number.
- We do not sell, rent or share your mobile number or text-message consent with third parties for their own marketing. We share it only with the service providers that send our messages.
Messages about an order you placed (build confirmations, photos, shipping updates) are service messages and are not marketing.
22. Intellectual property and vehicle trademarks
The CarbonPower name and logo, our photos, designs, text, graphics and site layout belong to CarbonPower and may not be copied or used without our written permission.
CarbonPower is an independent aftermarket company. We are not affiliated with, sponsored by, licensed by or endorsed by any vehicle manufacturer. Our products are aftermarket parts: they are not original equipment and are not manufactured, tested, certified or endorsed by any vehicle manufacturer. Vehicle makes, model names and chassis codes appear on this site only to identify which vehicles our parts fit, and all such trademarks belong to their respective owners. Photos on our site and social media show finished customer builds.
Manufacturer logos and badges are their owners' trademarks. We do not reproduce them, stitch them or include them in custom designs, and we do not sell emblems or badges on their own.
23. Privacy and website use
We collect the information needed to process orders, support you, prevent fraud and ship your order, as described in our Privacy Policy. We do not sell customer data. Payments are handled by third-party payment processors. You may not copy site content, try to access the site without permission, use it for anything unlawful, submit false information or abuse promotions. We may suspend access or refuse service at any time.
24. Arbitration and class-action waiver
Please read this section carefully. It means most disputes between you and CarbonPower will be decided by a neutral arbitrator instead of a judge or jury, and only on an individual basis.
Talk to us first. Before starting arbitration or any lawsuit, send us a written notice of your dispute at carbonpowercustoms@gmail.com that includes your name, order number, a description of the problem and what you want. We will do the same if we have a claim against you. Both of us agree to try in good faith to resolve it for at least 30 days.
Agreement to arbitrate. If we cannot resolve it, any dispute or claim between you and CarbonPower arising out of or relating to these Terms, our website, or any product you bought from us, including its installation or use, will be resolved by binding individual arbitration under the Federal Arbitration Act. The American Arbitration Association (AAA) will run the arbitration using its Consumer Arbitration Rules, available at adr.org. The arbitrator, not a court, decides questions about whether a dispute must be arbitrated, except that a court decides any question about the class-action waiver or the mass-filing process below.
Costs and location. Your share of AAA filing fees will not exceed the filing fee you would pay to start a case in your local court. CarbonPower pays the rest of the AAA administrative fees and the arbitrator's fees, unless the arbitrator finds your claim frivolous or brought for an improper purpose. Each side pays its own attorneys' fees unless the law or the arbitrator awards them. Hearings take place by video or phone, or in person in the county where you live or in Miami-Dade County, Florida, whichever you choose.
Exceptions. Either of us may instead take an individual claim to small-claims court if it qualifies. Either of us may also ask a court to stop infringement of intellectual property. Nothing here stops you from reporting a concern to a government agency.
No class actions; no jury. You and CarbonPower each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not combine more than one person's claims and may award relief only to the individual party asking for it. You and CarbonPower each waive the right to a jury trial.
Mass filings. If 25 or more similar arbitration demands are filed against CarbonPower by or with the help of the same law firm or organization within 90 days, they will be handled in batches of up to 25, with one arbitrator per batch, and the next batch will begin after the earlier one ends, unless the AAA's mass-arbitration rules require otherwise. Filing deadlines are paused while demands wait for their batch.
30-day opt-out. You can reject this arbitration agreement by emailing carbonpowercustoms@gmail.com within 30 days after your first purchase, with the subject line "Arbitration Opt-Out" and your name, order number and email address. Opting out does not affect any other part of these Terms, and disputes would then go to the courts named in section 25.
If part of this section is not enforced. If the class-action waiver is found unenforceable for a particular claim, that claim (and only that claim) will be decided in court under section 25, not in arbitration. If any other part of this section is found unenforceable, the rest stays in effect.
25. Governing law and courts
These Terms are governed by Florida law and, for section 24, the Federal Arbitration Act, without applying conflict-of-law principles. For any dispute that is not arbitrated (including if you opted out), you and CarbonPower agree to the exclusive jurisdiction of the state and federal courts in Miami-Dade County, Florida, except that either of us may use small-claims court. To the extent the law allows, any claim relating to a purchase must be brought within one year after it arises.
26. Changes, severability and entire agreement
We may update these Terms from time to time. The version posted when you place an order applies to that order, and we will not apply a change to the arbitration section to a dispute you already told us about. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and the policies they reference make up the full agreement between you and CarbonPower about your purchase.
